Terms of Use

1. Acceptance of These Terms

By accessing or using BIF, you represent that you have read, understood, and agree to be bound by these Terms of Use and all policies incorporated by reference. If you do not agree, do not use the Services.

If you use the Services on behalf of a company, practice, facility, or other organization, you represent and warrant that you are authorized to bind that entity, and references to "you" include both you and that entity.

BIF may update these Terms from time to time. Updated Terms become effective when posted or as otherwise stated. Your continued use of the Services after the effective date of revised Terms constitutes acceptance of the revised Terms.

2. The Services

BIF is a healthcare-adjacent directory and information platform designed to help users search for breast imaging facilities, compare publicly displayed information, read educational content, and, where available, contact facilities through links or other tools. BIF also offers tools that allow facility representatives to claim and manage listings and, if eligible, subscribe to enhanced profile services.

BIF may include unclaimed listings, claimed listings, verified listings, badges, filters, educational materials, reviews, provider dashboards, support tools, pricing pages, and promotional offers. Features may change, be discontinued, or be made available only to certain users at BIF's discretion.

3. No Medical Advice; No Emergency Use

BIF is not a medical provider, radiology practice, hospital, insurer, or emergency service. The Services do not provide medical advice, diagnosis, treatment, or referral guarantees and are provided for general informational and directory purposes only.

Always seek the advice of a qualified healthcare professional regarding medical questions. Do not use BIF for medical emergencies. If you think you may be experiencing a medical emergency, call 911 or go to the nearest emergency department immediately.

Educational content on BIF is general in nature and may not apply to your individual circumstances. Reliance on any content available through the Services is at your own risk.

4. Listings, Statuses, Source Data, and Badges

BIF may display facility information derived from publicly available, third-party, provider-submitted, or internally reviewed sources. BIF does not guarantee that any listing is complete, current, or error-free.

Unless BIF expressly states otherwise, public status labels have the following meanings:

"Claimed" means the listing has been claimed by a representative that BIF has approved to manage the profile on behalf of the facility.

"Verified" means only that the facility appears in the FDA MQSA mammography facility certification listing as reflected in BIF's most recent source data or review process. "Verified" does not mean that FDA, BIF, or any other person recommends the facility, guarantees quality of care, or certifies superior outcomes.

Accreditation, certification, convenience, and service badges may be based on documentation, source data, provider submissions, or internal review rules. Different badges do not carry the same meaning and should not be interpreted as equivalent endorsements.

Facilities may continue to appear in the directory even if unclaimed. BIF may edit, suppress, add, remove, or correct listing information at any time.

5. Eligibility and Accounts

You must be at least 18 years old and legally capable of entering into a binding agreement to use account-restricted features. If BIF offers account access, you are responsible for maintaining the confidentiality of login credentials and for all activity occurring under your account.

You must provide accurate, current, and complete information and promptly update it if it changes. BIF may suspend or terminate accounts that contain false, incomplete, misleading, or unauthorized information.

6. Provider Claims, Managed Listings, and Enhanced Profiles

If you submit a facility claim, request dashboard access, upload verification materials, or manage a facility profile, you represent and warrant that you are authorized to act on behalf of the facility and to submit, update, and control information for that listing.

You authorize BIF to verify your identity, role, affiliation, and authority, including by contacting the facility directly, contacting alternate contacts, reviewing public records, and reviewing submitted documentation.

BIF may approve, deny, condition, suspend, remove, or revoke claimed status, provider access, enhanced features, or badges at any time if submitted information is false, unverifiable, expired, misleading, incomplete, infringing, unlawful, or otherwise creates legal, reputational, or operational risk.

Structured listing fields may, in BIF's discretion, be published more quickly than free-text or custom content. BIF may require review, editing, reformatting, or rejection of any profile content before or after publication.

If BIF offers free or paid enhanced profile services, pricing, billing, promotional eligibility, renewal, cancellation, refund, trial, and discount terms may be governed by separate provider-facing or order-form terms.

7. Reviews, Ratings, and User Content

BIF may permit users to submit reviews, ratings, comments, feedback, questions, photos, or other content ("User Content"). You retain ownership of your User Content, but you grant BIF a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, perform, format, publish, distribute, moderate, and otherwise use that User Content in connection with the Services and BIF's business.

You are solely responsible for User Content that you submit. You represent and warrant that your User Content is accurate to the best of your knowledge, lawful, noninfringing, not misleading, and does not violate any privacy, publicity, confidentiality, intellectual property, or other rights.

You may not submit User Content that is defamatory, obscene, harassing, abusive, discriminatory, fraudulent, impersonating, threatening, deceptive, unlawful, or medically dangerous. Do not submit sensitive personal information, patient medical records, insurance information, Social Security numbers, or other highly sensitive health information through public reviews or open text fields.

BIF may use automated tools and human review to screen, moderate, rank, suppress, remove, or refuse User Content, but BIF is not obligated to review all content. BIF does not endorse or guarantee the accuracy of reviews, ratings, or other user-submitted statements.

8. Prohibited Conduct

You agree not to: (a) violate any law or regulation; (b) use the Services in a deceptive, fraudulent, or misleading manner; (c) scrape, harvest, or collect data from the Services except as expressly permitted; (d) interfere with the security or operation of the Services; (e) upload viruses, malware, or harmful code; (f) attempt to gain unauthorized access to systems, accounts, or data; (g) submit false facility claims or impersonate any person or entity; (h) exploit the Services to advertise illegal or prohibited services; (i) use the Services to stalk, harass, or threaten others; or (j) use bots or automation to generate spam, fake reviews, or artificial engagement.

BIF may investigate suspected violations and may cooperate with law enforcement, regulators, rights holders, or affected parties.

9. Intellectual Property

The Services, including the BIF name, logos, design, software, layout, compilation, text, graphics, audiovisual material, and other platform content, are owned by BIF or its licensors and are protected by intellectual property and other laws.

Subject to your compliance with these Terms, BIF grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for their intended purposes. No other rights are granted. You may not copy, reproduce, modify, distribute, publicly display, create derivative works from, reverse engineer, or commercially exploit the Services except as expressly authorized in writing.

If you submit content for a managed listing or enhanced profile, you represent that you own or control the necessary rights, and you grant BIF the license reasonably necessary to host, display, format, reproduce, and distribute that content through the Services.

10. Third-Party Services and Links

The Services may link to third-party websites, mapping tools, scheduling tools, provider websites, payment processors, social media platforms, or other third-party services. BIF does not control and is not responsible for the content, policies, availability, security, or practices of third parties.

Any dealings you have with third parties are solely between you and the third party. Inclusion of a link, badge, integration, or third-party tool does not imply endorsement by BIF.

11. Privacy

Your use of the Services is also governed by the BIF Privacy Policy, which describes how BIF collects, uses, discloses, and protects personal information. By using the Services, you acknowledge that you have reviewed the Privacy Policy.

Because BIF operates in a healthcare-adjacent context, you agree not to send unnecessary sensitive medical or health information through public areas of the Services unless BIF expressly requests it through a secure workflow.

12. Communications and Electronic Records

By using the Services, creating an account, submitting a claim, contacting support, or providing contact information, you consent to receive electronic communications from BIF, including notices, disclosures, transactional messages, verification requests, and service-related communications.

You agree that electronic records, notices, and signatures satisfy any legal requirement that such communications be in writing, to the extent permitted by law.

13. Promotional Offers and Pricing Disclosures

BIF may present promotional offers, discounts, trial periods, annual savings, or introductory pricing. All promotions are subject to the specific terms presented at the time of the offer and may be modified, suspended, or withdrawn to the extent permitted by law.

If there is a conflict between these Terms and a specific written promotional offer or provider order form, the specific written promotional terms will control with respect to that offer.

14. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIF DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, QUIET ENJOYMENT, AND THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

WITHOUT LIMITING THE FOREGOING, BIF DOES NOT WARRANT THAT ANY LISTING, BADGE, REVIEW, EDUCATIONAL ARTICLE, SEARCH RESULT, OR PROVIDER SUBMISSION IS COMPLETE, CURRENT, ACCURATE, OR SUITABLE FOR YOUR NEEDS.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIF AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIF'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO BIF FOR THE APPLICABLE SERVICE DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) FIFTY U.S. DOLLARS (US $50.00).

Some jurisdictions do not allow certain disclaimers or limitations, so portions of this Section may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless BIF and its affiliates, licensors, service providers, officers, directors, employees, contractors, and agents from and against any claims, demands, actions, proceedings, damages, losses, liabilities, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to: (a) your use of the Services; (b) your User Content; (c) your breach of these Terms; (d) your violation of law or third-party rights; or (e) if you are a provider or facility representative, your listing content, badges, profile claims, promotional statements, or facility-related submissions.

17. Suspension and Termination

BIF may, without prior notice and in its discretion, suspend, restrict, remove, or terminate access to the Services, any account, any listing, any badge, or any content if BIF believes you have violated these Terms, created risk, infringed rights, provided false information, or otherwise acted inconsistently with the integrity or lawful operation of the Services.

Termination or suspension does not limit any rights or remedies available to BIF. Sections that by their nature should survive termination will survive, including ownership, licenses, disclaimers, limitations of liability, indemnification, dispute provisions, and general provisions.

18. Copyright and Intellectual Property Complaints

If you believe that any content on the Services infringes your copyright or other intellectual property rights, send a notice to BIF's designated contact at hello@breastimagingfinder.com with sufficient detail to identify the allegedly infringing material, your contact information, the basis for your claim, and any other information reasonably requested by BIF. BIF may remove or disable access to challenged material in appropriate circumstances.

19. Accessibility and User Feedback

BIF is committed to improving the accessibility and usability of the Services. If you encounter an accessibility barrier, inaccurate listing information, or other issue, please contact BIF at hello@breastimagingfinder.com or through the contact method identified on the website. BIF may use your feedback to improve the Services.

20. Dispute Resolution; Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles, except to the extent superseded by applicable federal law.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Seminole County, Florida, and each party consents to the personal jurisdiction and venue of those courts.

21. General Provisions

These Terms, together with the Privacy Policy and any additional terms incorporated by reference, constitute the entire agreement between you and BIF regarding the Services, except where separate written provider or order-form terms expressly apply.

If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect.

BIF's failure to enforce any provision will not constitute a waiver. You may not assign these Terms without BIF's prior written consent. BIF may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.

Section headings are for convenience only and do not affect interpretation.
